By accessing or using any part of the FocusEd Platform, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you are using FocusEd on behalf of a school or organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not use the Platform.

3. Description of the Platform

FocusEd is an automated classroom focus system that:

FocusEd requires BLE-compatible beacons installed in classrooms. Beacon hardware is not provided by SafeHalo and is the School's responsibility to procure and install.

4. Eligibility

Schools: FocusEd is available to accredited K-12 educational institutions. By registering, the School represents that it is a legitimate educational institution and that the administrator completing registration is authorized to do so.

Parents: You must be 18 years of age or older and be the legal parent or guardian of the student whose device you are enrolling. By enrolling a student device, you confirm that you have the legal authority to consent to the installation of device management software on that student's personal device.

Students: Students do not create accounts independently. Student devices are enrolled through the Parent enrollment flow only.

Parents retain the right to unenroll their child's device at any time. Upon unenrollment, restrictions will cease immediately.

7. Student Use

Students using FocusEd agree to:

FocusEd does not prevent students from accessing emergency services (911) or contacting approved contacts at any time. These exceptions are always active regardless of restriction status.

8. Subscriptions and Billing

Subscription Plans

FocusEd operates on a subscription model billed to parents. Monthly and annual subscription plans are available. Pricing is displayed within the Parent App at the time of enrollment.

Free Pilot Period

Schools and parents participating in the FocusEd Alberta pilot program may be offered a free access period. The terms and duration of any pilot arrangement will be communicated in writing separately.

Payment Processing

All payments are processed by Stripe, Inc. SafeHalo does not store payment card details. Stripe's terms of service apply to payment processing.

Cancellation

Parents may cancel their subscription at any time through the Parent App. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused periods unless required by applicable Canadian consumer protection law.

Failed Payments

If a subscription payment fails, SafeHalo will attempt to retry the charge. If the payment cannot be collected, restriction enforcement on the enrolled device will be suspended until the subscription is renewed.

9. Acceptable Use

You agree not to use the FocusEd Platform to:

Important: FocusEd is designed exclusively for use in registered classroom zones during scheduled class periods. Any use of the platform to restrict student device access in bathrooms, change rooms, common areas, or outside school hours is a violation of these Terms and may constitute a violation of applicable law.

10. Intellectual Property

All intellectual property in the FocusEd Platform — including software, algorithms, user interface design, documentation, and branding — is owned by SafeHalo Technologies Inc. or its licensors.

SafeHalo's core distraction-prevention technology is protected by patent. Unauthorized use, reproduction, or commercialization of our technology is prohibited.

Nothing in these Terms grants you any right, title, or interest in SafeHalo's intellectual property beyond a limited licence to use the Platform for its intended purpose.

You retain ownership of any data you provide to the Platform (school configurations, student roster data, emergency contacts). You grant SafeHalo a limited licence to process that data solely to provide the service.

11. Privacy and Data

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using FocusEd, you consent to our data practices as described in the Privacy Policy.

We comply with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA). Schools in Alberta should also refer to the Freedom of Information and Protection of Privacy Act (FOIP) in their own operations.

12. Disclaimers

FocusEd is provided "as is" and "as available". While we work hard to maintain a reliable and accurate platform, we make no warranties regarding:

BLE beacon detection depends on physical environment conditions, device Bluetooth settings, and operating system versions. SafeHalo does not guarantee detection within any specific time window in all environments, though our target is within 30 seconds of zone entry under standard conditions.

FocusEd is a tool to support classroom management — it is not a substitute for school policies, teacher supervision, or parental engagement.

13. Limitation of Liability

To the maximum extent permitted by applicable Canadian law, SafeHalo Technologies Inc. will not be liable for:

SafeHalo's total cumulative liability to any User in connection with the Platform will not exceed the amount paid by that User (or their school) to SafeHalo in the 12 months preceding the claim.

14. Termination

By you: Schools may terminate their account at any time by contacting hello@focused.education. Parents may cancel their subscription at any time through the Parent App. Upon termination, restriction enforcement ceases on all enrolled devices associated with the account.

By SafeHalo: We reserve the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or poses a risk to the safety or privacy of users. We will provide reasonable notice before termination except where immediate action is required for safety reasons.

Upon termination, your right to use the Platform ceases immediately. Data deletion following termination is governed by our Privacy Policy.

15. Governing Law

These Terms of Service are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Platform will be resolved in the courts of Alberta, Canada. You consent to the exclusive jurisdiction of those courts.

16. Changes to These Terms

We may update these Terms from time to time. When we do:
